This week’s Sugya will discuss the concept of Tadir Kodem
with regards to kiyum hamitzvos. The source for this rule is found in Parshas Pinchos) which discusses the Korbanos and the order
which they should be brought, when more than one Korban is required.
The Gemara derives from here, that when two Mitzvos come into
conflict, the one that is more frequently observed takes precedence. We discuss
if this rule is an actual chiyuv min Hatorah,
or only an Asmachtah. We will also explore if this simply is a matter of
precedence, or does it completely negate the other mitzvah? This Halacha has ramifications in our daily life, including Tallis and Tefillin, Mincha Gedolah/Ketanah,, Maariv, Mussaf, Mezuzah, Kiddush Levana, Krias Hatorah, Krias Hamegilah, Sefiras Haomer, ner Shabbos,
and Chanuka lighting, etc..
